Nintendo Sued Over Alleged “Unlawful” eShop Practices

Nintendo Opting for Different Black Friday Approach

Despite the good amount of sales for the Nintendo Switch this holiday season thanks to the recently released Super Smash Bros. Ultimate, not everything in the company is merry. It appears that Nintendo has found themselves with a lawsuit with regards to claims of alleged “unlawful” eShop practices.

The lawsuit was filed by Germany, or more accurately the German government, for “unlawful” consumer practices as the Nintendo eShop does not allow for pre-order cancellations whatsoever.

The issue first arose when Norway tested the eShop for consumer unfriendly practices, and accused Nintendo of doing so by not allowing pre-order cancellation. Nintendo responded back saying that they aren’t breaking any laws, because pre-loading the game after pre-ordering fulfills the “performance has begun” wording of the sales contract.

This time, Germany via the German Consumer Authorities has looked at more recent information, and sided with Norway against Nintendo, especially as Nintendo hasn’t made any revisions.

The whole court process is likely to take an entire year, and is set to begin in the next 3 or 4 weeks. If this issue continues to escalate, the case may be brought to the EU courts instead.

Pokdepinion: Oh boy, just when I thought it would be a great time for them. Then again, this kind of issue is expected. Guess we’ll have to see what happens next.
